This website www.myrunwayau.com.au (“Website”) is owned and operated by My Runway Au (ABN 70 132 609 014).
These Terms and Conditions (“Terms”) apply to the renting of products from the Website, and form a contract between you and My Runway Au. By making a booking through our Website, you are agreeing to accept and consent to the practices in these Terms and Conditions, as described below. My Runway Au reserves the right to amend the Terms and Conditions at any time without notice. Since you are bound by these Terms and Conditions, you should refer to them each time you place an order.
Under these Terms and Conditions, this Website provides a service for clients to borrow designer attire from My Runway Au.
Through the Services, we aim to provide you with access to hire designer clothing, stylist advice and any relevant information to help you decide on the perfect item for you.
In these Terms, “you” and “your” refer to all users of this Website and “we”, “us”, “our” and “MR” refer to My Runway Au. References to users must be read as being also a reference to customers of My Runway Au.
Compliance of Terms
You will be bound by these Terms each time you submit an Order. Each Order you place will be a separate contract between you and My Runway Au for the rental of our products.
By ticking the “I accept” rental agreement checkbox at the checkout, you confirm that you have read the Terms and Conditions, understand them, and are bound by the Terms and Conditions.
Our Commitment to You
We will deliver the product that you have ordered with the correct size, colour and style. We will endeavour to have the products delivered to you on or before the date you have specified for delivery on your order. Except where we have indicated to you that your request for this is not possible or guaranteed and therefore your order has been amended.
Products may appear different in colour and style than the images listed on the Website. Our liability to you for failure to deliver a product you have ordered is limited only to timely delivery. If an order is not delivered on time and we have done everything in our power to get it to you on time (except for when the delay is caused by Australia Post, and is beyond our control), a store credit will be issued less the shipping charges.
Placing an Order
You may place an order to hire our products on our Website if you are 18 years of age or over, have an active email account or telephone number at which we can contact you on, and confirm that you are authorized to use the chosen method of payment.
You may place an order on behalf of a minor, however the Terms will apply to you.
My Runway Au will not be liable to you for loss you or any third party suffers for a delay or failure to process your Order or deliver the product due to inaccurate or incomplete details provided in your Order.
The “rental fee” for the products will be the rental fee (and delivery fees for Saturday deliveries to Brisbane residents) listed on the Website in relation to your rental of product(s). When you place an order, you authorise My Runway Au to charge your payment method for your rental fee. We will charge your method of payment immediately upon receiving your order.
In addition to your rental order for a product, you authorise My Runway Au to charge your payment method up to an amount equal to the original recommended retail price (RRP) of the product as set in the “RRP” on our Website plus $30. Your payment method will only be charged the RRP when you have not upheld your commitment to us as set forth in the rental agreement below.
Product Fit and Returns
Please ensure you have tried the dress/ style on for size before booking it as we do not offer refunds or store credit once your order has been shipped.
If you have any concerns regarding fit, please contact us at email@example.com prior to ordering and we will be more than happy to provide you with the item’s exact measurements.
My Runway Au’s delivery method is Express Delivery Service, operated by Australia Post (see Australia Post’s Terms and Conditions). Express Delivery is a guaranteed next day delivery within the Express Post network only, provided that orders are placed before 2pm Monday – Thursday. For orders placed after this time, we will post your item on the next day. If your location is outside of the Express Post network, it will take more than one business day and My Runway Au has no control over this. It is your responsibility to check that you are in the Express network before placing an order.
In the rare event that your item does not reach you in time for your event, email us at firstname.lastname@example.org and we will provide you with a credit note (minus the shipping cost), provided that you return the item on the next business day.
You may grant us an “authority to leave” when placing your Order. By doing so, you understand and agree that this authority to leave gives us and/or our selected couriers permission to leave the Order unattended by the front door, or, where applicable, at the reception or concierge’s desk of the delivery address without obtaining a signature confirming delivery at the delivery location. In such circumstances, you understand and agree that by granting us authority to leave, we and our couriers are released of all responsibility and liability for the Orders delivered and left unattended, and that this responsibility and liability transfer to you on delivery.
We do not take responsibility for orders where an incorrect/ ineligible address has been provided. Please check that you have supplied the correct address, as you will be liable for any late fees/ no return fees if the garment is not returned to us. A secure shipping address is highly recommended when placing your order.
By choosing signature on delivery, you are accepting that anyone on the premise can sign for your parcel. Once this item is signed for, responsibility and liability of the item will be transferred to you. If you are unavailable to receive your item, My Runway Au will not be held responsible for additional shipping delays.
Warning: If you are unavailable to sign for this delivery, it may be taken back to the depot or local post office for collection by you. It is your responsibility to be available for delivery of your item/s or collection of your item/s. Your rental period starts from the time the courier attempted first delivery and credits will not be issued for late delivery where you have not been available to accept the delivery.
With the delivery of your product, a pre-paid return satchel with tracking is provided. Please ensure that you place your garment inside the self-addressed satchel and return the satchel over the counter to an Australia Post Office, or the Yellow Australia Post street posting box by 5pm on the last day of your rental.
My Runway Au will not take responsibility for lost items mailed in Australia Post boxes. We highly recommend you return your item via an Australia Post Outlet where it will be scanned over the counter as proof of lodgement and the item will be deemed as returned. We will therefore accept responsibility for the item after the first scan. If you choose to return the item via the Yellow Australia Post road post boxes, and the item is not scanned and is lost by Australia Post, then you accept responsibility for the loss of the garment and will be required to pay the RRP as indicated on our Website plus $30 minus the rental fee already paid.
If you lose your return packaging, it is your responsibility to return the garment via trackable express post to My Runway Au at your own expense. In this instance, you will email us at email@example.com with the tracking number to avoid further charges. My Runway Au will not be held responsible for products which are late or lost in transit due to your chosen method of shipping.
Late Fee Policy
You agree to return your item/s on the order return date (or next business day if it falls on a weekend) by 5pm using the prepaid return satchel provided with your order. If you return your product late you will incur a thirty ($30) late fee for every day your item is late, up to a total of the RRP of the dress as indicated on our Website plus $30. However, if the late arrival affects another client’s booking, My Runway Au will charge the total Hire Fee of the garment for that weekend plus $30 per day for each additional day it has not been returned following the weekend. My Runway Au will use the payment method you have provided to us at the time of your Order. You agree to pay these late fees up to an amount equal to the RRP of the item plus $30. Late fee is payable regardless of whether you are a member or have used a credit for your order.
If you have not returned your product within 7 days of the return date, My Runway Au will make contact with you regarding the return of the item. You will be required to pay for the late fees incurred and to return the item immediately. If you do not respond to the contact made by My Runway Au, the item will be regarded as theft.
If the item is regarded as theft, My Runway Au will charge you the RRP of the item plus $30 postage plus the cost of hire of the item for each cancelled order My Runway Au has had to cancel as a result of your no return. In addition, My Runway Au will be filing a police report.
My Runway Au will send you an SMS and email reminder to the mobile number and email address you have provided us at your time of order.
As our garments may be hired by another customer after you, it is important that you return it to us on time so that we can have it professionally dry cleaned and sent out to the next customer.
If you do not pay the amounts owed to us when due, we will pass on the invoice/s to a collection company to pursue you for collections, including and without limitation attorney and collection fees at your expense. My Runway Au reserves the right to terminate your right to hire from us at any time at our own discretion should you breach this agreement.
We take no returns seriously and this will be regarded as theft. We will be filing a police report, and your details will be passed onto the relevant Authority.
Credit Card Authorisation
For each order, we will require you to return a signed copy of the Credit Card Authorisation Form. This will be treated as a security bond – and in the cases of a late return/ no return, as stipulated in the above Terms and Conditions, we will charge the nominated credit card. We will not charge your Credit Card without your knowledge. We will notify you in writing prior to charging your card.
On the return of the garment, your details will be permanently removed and erased from our Secure files.
Acceptance of Use of My Runway Au’s products
By hiring our garments, you agree to treat it like your own with the upmost of care. You will be responsible for any damage to the garment, such as but not limited to: fitting into something too small for you, damaged zips, fire damage or major stains. You will be responsible for theft or loss of the garment.
Normal wear and tear is considered as minor stains which can be removed with regular dry cleaning, small seam rips, missing beads and sequins. If you return a product and it is deemed damage beyond normal wear and tear then you agree that we shall charge you, and you will be responsible for the cost of repairing the garment if it is repairable. If the damage is beyond repair, My Runway will charge you the RRP of the garment on depicted on our Website plus $30. It is up to My Runway Au’s discretion whether the garment is deemed damaged beyond repair and beyond normal wear and tear.
My Runway Au is responsible for the dry cleaning of our garments. We dry clean and inspect all products with the upmost of care however use of the garment is at your own risk and My Runway Au shall not be held liable for any health-related complaints associated with a product rented from our Website. Our products have be worn by other clients prior to your rental.
You agree that you will not attempt to clean, alter, iron/press any of our garments. In the event that you have stained our garment, please contact us at firstname.lastname@example.org.
Cancellation and Refund Policy
You may cancel your rental order subject to the following cancellation fees and policies:
We will offer you a full refund if under any circumstances we cannot fulfil your order, such as when the item is not returned in time from a previous client. In such circumstances we will endeavour to notify you as soon as possible so that an alternative arrangement can be made.
If the dress is not the right size, we will endeavour to send an alternative style or size (subject to availability) and subject to courier service availability. In this instance, you will be responsible for the shipping charges.
We use the information provided from your order (Name, email address, shipping and billing addresses, phone numbers and payment methods) to fulfil your order request.
From time to time, we will send you email marketing, offers and promotions, if you wish us to do so. You may opt out at any time by emailing us at email@example.com.
We do not pass on any of your details including your email address to any other companies or corporations.
Credit Card Authorisations provided to us will be kept on our secure network until the garment is returned to us. Once the garment is returned, your details will be removed and erased from our network.
